| 摘 要： | 针对我国产品责任法律规定存在的某些不足,提出建议和对策,如制定独立的作为民法特别法的产品责任法;明确产品的含义,合理界定产品的范围;完善产品缺陷的认定标准及范围;进一步明确产品责任的责任主体;明确销售者承担责任的归责原则;完善产品责任的抗辩事由（免责条件）;完善产品责任的损害赔偿制度;以不断完善我国产品责任法律制度,更好地维护广大消费者合法权益。
