| 摘 要： | 我国体育法制建设取得了显著成就,但存在的问题依旧不少.采用文献资料、数量统计、对比分析等研究方法,在分析目前我国体育法制建设存在的主要问题的同时,借鉴欧美国家体育法制建设的相关经验,为我国体育法制的发展完善提供建议.我国体育法制的主要问题表现为体育立法层面的法律责任缺失、横向联系不足以及公民体育权利强调不够,公民体育法律意识不强,体育法规执行不力,体育法治与体育行业自治冲突.这些问题虽然表现形式不一,但相互之间交叉作用.欧洲国家在体育法规的体系建设及体育自治与体育法治关系处理方面的有益经验可供借鉴,而美国在法治理念宣传及法律执行层面的措施颇具参考价值.

| Abstract: | The sports legislation construction in China has made remarkable achievements though some problems still. This paper researches these problems of sports legislative and makes a comparison to those of European and American by the ways of literature review, mathematical statistics and logic analysis. Research suggests that there are 4 problems that the absence of legal liability of the legislative, sports legal consciousness of citizen is weakly, sports law enforcement ineffectively, the contradiction between sports law and sports autonomy. Although these problems are different, but there are interactions between each other. The legislative and regulations system construction of sports laws is worth learning. At the same time, and the concept of the rule of law publicity and law enforcing in United States is valuable. |
