| 摘 要： | 体育仲裁由于具有专业性、自治性等特点,是解决体育纠纷最有效的方式之一。我国体育法亦规定了体育仲裁制度,但实践中该制度并未真正建立起来。我国现行体育纠纷问题较多,建立我国体育仲裁程序制度意义重大。对体育仲裁的范围、体育仲裁的独立性仲裁原则、体育仲裁程序的完善以及体育仲裁裁决的司法救济几个问题进行深入探讨,以期对《体育仲裁条例》的制定有一定的借鉴作用。

| Abstract: | Sports arbitration has its own speciality,autonomy and so on characteristics.It is the most effective means for resolving sport dissension.Chinese sport laws also stipulates sports arbitration system,but in practice it does not establish in deed.By now there are lots of problems in present resolving mechanism;it has a big significance to establish sport arbitrage procedure system.This paper discusses thoroughly on the range of sport arbitration,independency arbitrage principle of sport arbitration,sport arbitration procedure of consummation and the judicature relieving,aiming to provide some references for establishing sport arbitration ordinance. |
