| 摘 要： | 精神损害赔偿制度在我国的确立标志着法律更加深入地保障公民的权益，随后多部法律相继出台，更是逐步完善了精神损害赔偿的相关内容。然而，在司法实践中该制度存在着许多问题，如赔偿范围具有局限性；法律没有规定具体明确的赔偿标准；司法实践中自由裁量性过大等，都急需解决。文章从研究精神损害赔偿制度的立法现状出发，分析该制度的含义和范围，并就其存在的问题及完善建议提出自己的看法。

| Abstract: | Mental damage compensation system in the establishment of China marks that the law safeguards more deeply the rights and interests of the citizens, and then issues many laws which have gradually been perfected regarding the re lated content of the mental damage compensation. However, in the judicial practice this system has many problems, such as, there is limitations about the scope of compensation ; the law has no specific compensation standards ; in the ju dicial practice the discretionary is too big, etc. , which are urgently needed to be solved. This paper studies the present situation of the system of mental damage compensation legislation, analyses the system of the meaning and scope, its ex isting problems and the suggestions for improvement. |
