| 摘 要： | 我国《防灾减灾法》的制定应该坚持“科学立法、民主立法”这一基本要求。在指导思想上，全面贯彻落实科学发展观，从我国客观实际出发，根据《宪法》、《立法法》等相关法律的规定，按照科学立法、民主立法的基长要求，创新法规击幛起草机制，完善人大、政府法制机构、政府职能部门、专家学者或社会组织参与的多元起草模式。可以考虑由地方先行，先出台各省、自治区、直辖市的《防灾减灾综合条例》，取得经验之后，再由全国人大常委会出面牵头制定出一部全国性的统一而成熟的作为防灾减灾基本法的《防灾减灾法》。

The Suggestions of Legislation Drafting on Disaster Prevention and Reduction Law --Using the Legislative Experience of Property Law for Reference and Transcendence |

| Abstract: | Reviewing the legislative process of Property Law in China, we will find that ＂scientific legislation and democratic legislation＂ is helpful to improve its quality. Our Disaster Prevention and Reduction Law should insist on the basic requirement of ＂scientific legislation and democratic legislation＂. The guiding principle on the establishment of Disaster Prevention and Reduction Law is that we should adhere to Marxism - Leninism, Mao Zedong Thought, Dang Xiaoping Theory and the ＂Three Represents＂, thoroughly implement the scientific concept of development, in the light of our own objective situations, on the basis of the Constitution Law of the People＇ s Republic of China and Legislation Law of the People＇ s Republic of China and relevant laws, in accordance with the essential requirement of scientific and democratic legislation, innovate the drafting mechanism, perfect the multivariant drafting pattern which is promoted jointly by NPC, government＇ s legal organization, government＇ s functional depa/tments, experts and scholars or social organizations. In the author＇ s opinion, it will be better for us to consider local action firstly. It means local govemments of provinces, autonomous regions and municipalities should launch Disaster Prevention and Reduction Comprehensive Regulations prior to the central government, and can accumulate some experience as well. And then, Standing Committee of the National People＇ s Congress should take the leading part to lay down a nationwide and relative mature Disaster Prevention and Reduction Law as the basic law in future disaster prevention and reduction work. |
