| 摘 要： | 危险责任制度是现代侵权法上的一项重要的制度，长期以来学术界对危险责任是否应该设定最高赔偿限额、是否应适用精神损害赔偿以及危险责任与过失相抵的关系问题存在争议，在分析评价学术界争论观点的基础上，笔者提出了危险责任不应该适用最高赔偿限额，危险责任可以适用精神损害赔偿和过失相抵。

| Abstract: | Dangerous liability is an important system in tort law. It is long controversial whether a maximum compensation limit should be established, spiritual damages and negligence setoff be applied to dangerous liability. After analyzing and evaluating various ideas about these issues, the present article puts forward that a maximum compensation should not be applied to dangerous liability, and compensation for spiritual damages and negligence setoff can coexist. |
