| 摘 要： | 随着现代体育运动的全球化、商业化,体育争议不断增多,尤其是涉及体育联合会的纪律处罚方面的争议。对于不服此类纪律处罚的裁决,申请人可以上诉至CAS。许多国际体育联合会也已经逐渐认识到CAS的作用,在其章程里授予CAS专属的管辖权,当争议发生时,申请人也只能向CAS提出上诉。因此,CAS的重要性日渐增强。笔者从CAS的管辖权、上诉仲裁程序、仲裁协议、纪律处罚的审查几方面对CAS审理纪律处罚争议问题进行了初步的考察。

| Abstract: | With the globalization and the commercialization,the sport disputes have been increasing,especially relating to the disputes of disciplinary sanction rendered by sports associations or other bodies.Counting to the decision of disciplinary sanction,applicant can subject to CAS.Many international sports associations have realized the role of CAS,and conferred the exclusive jurisdictional powers.When the dispute is emerged,the claimant has to appeal to CAS,and the importance of CAS has been strengthening rapidly.The author investigated the issue of disciplinary sanctions rendered by CAS from jurisdictional powers,the appeals arbitration procedure,the arbitration agreement and the review applied on disciplinary sanctions. |
