| 摘 要： | 对《奥林匹克标志保护条例》进行了全面审视，在肯定《奥林匹克标志保护条例》现实作用和重要意义的基础上，详细探讨了奥林匹克标志保护是否为我国的“国际义务”、奥林匹克标志权利属性认定、《奥标条例》融入我国法律体系、标志和权利人有关疑问、奥林匹克标志侵权救济途径等问题。认为《奥标条例》需要完善。但从现实需求和有关理论发展水平方面考虑，目前并非修订《奥标条例》的最佳时机，2012年或2016年奥运会之后考虑修订《奥标条例》才比较实际。在此之前应密切关注国际奥林匹克运动的发展、知识产权法的发展和我国体育事业的发展，不断加深有关理论和实践问题的研究，逐步积累奥林匹克标志保护经验。
