| 摘 要： | 现今的体育法体系是在传统法律体系理论的指导下建构的，我国体育法体系建设应该不断回应新形势下体育强国建设及体育法治进程的需要，为此，从软法视角切人，构建了以软硬法为基础的新的体育法体系，在建构过程中应该注意软法理性的提升、软硬法适用的优先问题、建立软硬法和谐相处的制动机制以及相互间的良性转化机制，最终，软硬法兼施，共同促进体育法治化进程。

| Abstract: | The sport law system at present is built on the direction of traditional theory of the sport law system g construction of the sport law system in our coun- try should be satisfied the need of nation powerful in sports and the course of rule by law in the new circumstances, so, from the angle of soft law, we build the new sport law system including soft and hard law, in the course of building, some problems should be attentive, such as improving the reason of soft law, suitable for use by soft law and hard law, building the system of braking and changing between soft law and hard law, at last, putting soft law and hard law into effect in order to promote the course of sport legality. |
