| 摘 要： | 运用文献资料法、专家访谈和逻辑分析法等方法，从法理学角度阐释了体操裁判自由裁量权的含义与特征；从规则的不完备性、规则确认的自由裁量和规则与事实对接等三方面分析了体操裁判行使自由裁量权的存在依据；从证据确认、事实认定和规则适用三方面论述了体操裁判评分自由裁量的程序。对近年来在世界体操大赛中有关裁判行使自由裁量权的个别案例进行实证分析。

| Abstract: | The paper uses the method of literature review; investigating experts; logical analysis, explains the meaning and characteristic of the judicial discretion on referee of the Soccer from the view of the Free Jurisdiction. Introduces the different conjunction to the judicial discretion and the main reasons, and preliminarily explains the need of the judicial discretion based on the jurisprudence and economics perspective to the study. While the selected cases are arisen in the FIG compaction recently, and the purpose is to make the analysis more general. |
