| 摘 要： | 为了解决我国港口经营人赔偿责任限制制度的立法空白和司法混乱问题，在介绍港口经营人定义的基础上，论述我国法律体系下港口经营人的法律地位问题，确定其独立合同人的法律地位.通过借鉴最新国际立法《鹿特丹规则》下港口经营人赔偿责任限制制度的相关规定，探讨我国建立港口经营人赔偿责任限制制度的合理性.最后论证建立我国港口经营人赔偿责任限制制度的最佳途径为在《中华人民共和国海商法》中明确增加相关规定.
