| 摘 要： | 基于对《航道法(草案)》的各种意见,分析研究航道的所有权问题,《航道法》的立法目的、调整对象、基本原则、调整手段、体例,航道管理主体的职责,认为:航道所有权应明确界定为国家所有;《航道法》的立法目的应明确航道在水资源合理开发利用中的地位,而非仅为航运提供服务;《航道法》的调整对象是行政关系而非行政、民事关系兼备;《航道法》的基本原则存在数量不够、提法不准的问题;《航道法》的调整手段包括刑事、民事和行政手段;并着重提出应删除《航道法(草案)》第3章"航道资金"部分,将其有关内容写在航道建设和养护中;航道管理者应承担保护合法使用者权利、保障畅通安全的义务.

| Abstract: | Based on the collected opinions of "Waterway Law(Draft)", the study analyzes and does researches on the proprietary rights of waterway,the legislative objective,adjustment objects,basic principles,the adjustment measures,system arrangements and the obligations of waterway administrators.The study is of opinion that the proprietary rights of the waterway should be clearly prescribed as state-owned;the legislative objective of "Waterway Law" should confirm the waterway's status in the reasonable development and utilization of water resource in addition to providing shipping services;the adjustment objects of "Waterway Law" are not administration-related,but not both administrative and civil;there're insufficient quantities and inaccurate terms of basic principles prescribed in "Waterway Law";the adjustment measures of "Waterway Law" include criminal,civil and administrative measures;"Waterway Fund" in Chapter Three of "Waterway Law(Draft)" should be deleted and relevant contents should be included in waterway construction and maintenance;the administrator of waterway should shoulder the obligations of protecting the rights of legal users and guaranteeing the easy and safe passage of the waterway. |
