| 摘 要： | 财产共有制度作为一项重要的民事法律制度在各国民法中均有体现,但是我国《海商法》中关于共有船舶抵押权设定的规定却显得比较模糊。本文运用物权法的基本理论对此问题作了深入探讨,并从不同角度提出了对《海商法》第16条规定的理解。
