| 摘 要： | 为研究欧盟理事会第1419/2006号条例取消赋予班轮公会反垄断豁免后,世界主要航运国家未来班轮运输管制体制和立法将会发生重要变化,从班轮公司传统合作形式、欧盟取消班轮公会反垄断豁免的影响出发,对后班轮公会时代的来临、后班轮公会时代的国际班轮市场结构、后班轮公会时代的国际航运市场管制立法、协商协议和运营协议的未来进行阐述,提出国际班轮公司之间的合作形式和范围将发生重大变化,班轮公会的衰落已不可避免,运营协议将是未来班轮公司主要合作形式.在国际班轮公司合作形式立法问题上,我国《航运法》的制定不仅要从我国进出口贸易班轮运输市场的实际出发,也要高度关注国际立法趋势.

| Abstract: | In order to study the important changes of future regulation system and legislation in major shipping countries after EU Council Regulation No.1419/2006 repealed antitrust exemption,the coming of the post-liner conference time, the structure and the legislation of regulations of the international (shipping) market at the time of post-liner conference,and the future of discussable agreements and operational agreements are put forward based on the traditional cooperation types among liners,and impact of exemption of antitrust of liner conference.The viewpoint that great changes on cooperation types and scope(among) liners will result in the inevitable decline of the liner conference is put forward.Operation agreements will be the main type of liner cooperation.Making Chinese Shipping Law should base on the actual situation of Chinese liner transportation in foreign trade,and pay close attention to the international legislation trend in cooperation types among liners. |
