| 摘 要： | 逮捕作为我国《刑事诉讼法》规定的刑事强制措施之一,对于保障刑事诉讼活动的顺利进行起到了非常重要的作用。但是由于现行立法未能构造一个合理的逮捕标准,无法较好地规范司法,导致实践适用中出现了不少的问题,影响了逮捕制度功能的充分发挥,这引发了理论界的质疑和实务部门的反思,因此亟需给予切实的关注和研究。

| Abstract: | Arrestment,as one of the criminal compulsory measures stipulated by the Criminal Procedure Law,plays an important role in implementing criminal proceedings.But problems arise as a result of lack of a reasonable standard of arrestment in the current law to regulate the judicial practice,hindering the mechanism from functioning to its fullest.The academia and executive bodies are then very much concerned about this issue,which is in great need of more attention and better study. |
