| 摘 要： | 产品责任损害赔偿作为产品责任制度的重中之重，其范围的设置不仅直接关系到受害者的利益能否得到有效保护，而且体现了法律对侵权行为遏制作用的强弱。目前，就产品责任损害赔偿中的产品自身损害及纯粹经济上的损失赔偿、精神损害赔偿和惩罚性损害赔偿几个问题而言，世界各国立法规定与学界观点存在很大差异。通过对国内外立法现状及学界不同观点的比较分析，可以明晰我国立法上是否应该就以上问题予以明确，以及如何具体加以规定以指导日益变化、纷繁复杂的社会现实纠纷的解决，完善我国的产品责任损害赔偿制度，切实保障人民的生命与财产安全。
