| 摘 要： | 在中小学生体育伤害事故中,学校承担责任的归责原则应采用过错责任原则。当学生是无民事行为能力人时,对于校方的过错认定应适用过错推定规则;当学生是限制民事行为能力人时,对于校方的过错认定应适用一般过错责任原则。这样,利于实现学生与学校之间的利益平衡。

| Abstract: | Sports injury accidents in primary and middle schools should be settled according to the fault principle on the part of the schools.When students are still persons with no legal capacity,presumption of fault should be adopted to determine the schools’ liability.When students are the persons with limited capacity for civil conduct,fault principle should be applicable.This will create the balanced interest between schools and students. |
