| 摘 要： | 运用文献研究法,就我国体育彩票若干法律问题的不同观点,从民法学和行政法学的角度进行分析.认为体彩中心不具有行政主体的法律地位,而是总局委托授权的事业组织;各省级体彩中心与代销商签订的是委托代销合同而非行政合同;彩民因购买体育彩票与彩票发行机关订立的合同为射幸合同.

| Abstract: | By using the method of documentary, this article analyzes the different viewpoint of legal question on our national sports lotteries by code of civil law and administrative law. The writer consider that sports lotteries center do not have legal status of administrative main body, but a public organization authorized by General Administration of Sports; Every provincial sports lottery center which contract to the commission agent is commission contract and not the administrative contract.The contract which signed between lottery fans and sports lottery issue department is an insurance contract. |
