| 摘 要： | 著作权的刑事立法旨在于切实保护权利人的合法权益,维持社会正常的版权贸易和商业交往,最终实现公正的、合理的自由竞争理念。考察我国刑法保护现状,有必要加强对著作权的刑法保护。我国有关著作权的刑事立法在司法实践中存在不少问题。从维护社会主义市场经济秩序,保障公平竞争的角度出发,应进一步完善我国的著作权刑事立法,文章从五个方面提出完善建议。

| Abstract: | The intention of criminal law legislation is to practically protect the right,maintain the well-balanced social copyright trade and commercial communication,and finally achieve the free competition conception in a fair and reasonable way.Concerning the situation of crimal law protection in China,it is necessary to put emplasis on crimal law protection of copyright because of the particularity of offending the copyright.To safeguard the socialist market economic order and ensure fair competiton,it is needed to improve our criminal copy right legislation.There are many problems in the judicial practice about this problem.The article brings forward some suggestions from five aspecfs. |
