| 摘 要： | 法作为规范的一种,由于种种原因在我国极易与政策相混淆,造成实践中操作混乱。同时从经济发展、社会变迁的角度而言,法逐步出现社会化的趋势,民间法也需要纳入法的视野。因此笔者认为法首先应强调其是作为司法机关办案的依据的规则。

| Abstract: | As one of the criterions set down by the nations, laws are likely to be confused with policies in practice. From the point view of social development and changes, laws tend to be socialized, so folklaws should also be considered as a part of the criterions. The author holds the idea that emphasis should be initially put on laws as basis of judging cases. |
