| 摘 要： | 正义是古今人类普遍追求的一种价值目标。西方和现代社会所理解的主要是社会正义,主张通过构建符合正义原则的制度来保证和实现正义。中国传统追求的主要是人格正义,它是个体正义。在当前的制度建设中,要充分认识传统的人格正义忽视制度建设和制度正义的弊端,同时要注意制度与传统文化的相容性,还要发扬传统人格正义对制度的支撑,加强社会主义精神文明建设。
