| 摘 要： | 版权法自从产生的那天起,便与技术紧紧联系在一起。科学技术的每一次革命,都不同程度的引起了版权领域的变革,特别是在进入信息化时代后,二者之间的关系更为休戚相关。从版权客体制度着手,分析了数字技术的发展给版权客体、概念、保护要件及准则等一系列理论带来的变化。通过对大陆法系与英美法系以及我国立法司法实践的对比,着重介绍了数据库这一独创性程度较低的作品,在各国的理论与实践中是如何予以保护的,以寻求一个适合我国国情的数据库保护制度。从版权理论的最基础层次来揭示计算机时代整个版权制度的变化趋势。

| Abstract: | Since the birth of copyright laws,they are closely related with technology.Copyrights often change with the revolutions of science and technology: in the information era,the relations between copyrights and technology become much closer.On the basis of copyright object systems,this paper analyzes the changes in the theories of objects,concepts,protection elements and criteria of copyrights with the development of digital technology.Comparing the continental law systems with British and American law systems and with China's judicial practices,the paper mainly discusses the methods adopted theoretically and practically by different countries to protect their databases,which have relatively low originality,so as to establish a protection system of databases that is suitable for China's current conditions.All in all,this paper tries to reveal the development tendency of copyright systems at the computer age according to the basic theories of copyrights. |
