| 摘 要： | 摘要：采用法规检索、文献研究、规范分析等法学研究方法，对改革开放40年来我国体育法治建设的经验、教训和未来努力方向进行了研究，指出我国体育法治大致经历了孕育阶段、体育法制创建阶段和法制健全阶段，各阶段都有标志性事件和法规的出台。40年体育法治始终伴随我国依法治国的进程，伴随着我国体育行政管理体制改革而发展，但相比其他领域，体育法治的进程相对缓慢，存在着立法粗放、执法不严、执法力量薄弱、体育纠纷解决机制不健全等问题。未来的体育法治应实现立法由管理型转向权利保障型，优化执法机制，强化执法力量，严格执法，并建立专业化的体育纠纷仲裁和审判制度，全面实现法治体育，实现体育强国的宏伟目标。

| Abstract: | Abstract: By means of law research methods such as law retrieval, literature research and normative analysis, this study analyzed the experience, lessons and future direction of the construction of sports rule of law in China in the past 40 years of reform and opening-up, and pointed out that the rule of law in sports in China has gone through three stages: gestation stage, establishment stage and perfection stage; significant events and laws have appeared in all stages. In the past 40 years, the rule of law in sports has always been accompanied by the process of ruling the country by law and the reform of sports administration system in China. However, compared with other fields, the process of the rule of law in sports is relatively slow. There are such problems as extensive legislation, lax law enforcement, weak law enforcement, and imperfect mechanism for solving sports disputes. In the future, the rule of law in sports should realize the transformation of legislation from management-oriented to rights-guaranteed, optimize law enforcement mechanism, strengthen law enforcement power, strictly enforce the law, and establish a professional arbitration and trial system for sports disputes, so as to realize the rule of law in sports in an all-round way and realize the grand goal of a sports power. |
