| 摘 要： | 体育社会团体是非营利性社会组织,它所行使的处罚权来自于国家权力的授权,是"准行政权"。体育社会团体行使其处罚权的依据是其团体章程,但体育社会团体章程须明确其处罚权的原则、范围、形式等。体育社会团体行使处罚权要遵循章程规定的正当程序。同时,作为被处罚人可以享有一定的处罚救济权利。《体育法》应进一步完善体育社会团体的处罚制度。

| Abstract: | The sport social group is non-profit social organizations.Its punishment power comes from the state power authority,and it is the quasi-executive power.The basis for the exercise of its power to punish is based on the group charter.
