| 摘 要： | 中华人民共和国成立的60来,特别是改革开放以来,在中国不断迈向现代化的社会转型中,伴随着民主与法治的历史发展,中国的人权事业和人权法治取得了巨大的进步。作为中国现代化发展重要组成部分的体育事业,同样置身于经济社会发展和人权法治加强的整体环境,正在逐步形成凸现体育人权保护的法治化格局。体育权已经进入中国的官方话语,成为中国人权整体发展的重要构成。中国通过宪法、体育法和其他立法,多方面对公民体育权利进行了确认与保护。中国坚持以人为本和权利本位的法治理念,在不断满足各种体育权利的诉求中获得体育的和谐与发展。在中国全面建设小康社会与和谐社会的现代化进程中,努力实现广大民众在法治保障下的体育权利,是中国体育和谐发展的必然选择与历史追求。
