| 摘 要： | 运用文献研究法、对比法、逻辑法、分析法和专家访谈法等，从我国教育、体育法律法规角度出发。结合学校体育实际，分析探讨了学校体育教师权利的享有依据、实现方式及救济方法，为切实推进学校体育中素质教育和依法治教、依法治体及践行以人为本，提供参考依据。主要结论：我国体育教师尤其是农村体育教师的基本权利处于法定权利阶段，未真正进入实有权利阶段，同时救济渠道单一；体育教师基本权利享有、实现与救济既是重要理论问题又是重要实践问题。建议：更新教育观念；进一步加强相关立法数量和质量；当体育教师合法权利受到侵犯时应鼓励和提倡教师依法提起申诉和诉讼。

| Abstract: | This paper put to use based on document study and logic approaches and call on specialist and contrast the present with the past. On the law of education and physical education point of view combine the facts of school education find out basis for the realization and provide relief to the physical education teacher＇s right, in order to for reference only to quality education and rule by law is practiced within china school physical education. To conclusions： at present, the physical education teachers right system has not entered into the realistic right stage and the channels of social relief is not be easily accessible in our country. It is important to renew sense of education and strengthen the legal system from the unity of theory with practice in school education. Suggest： renewal education idea; reinforce lawmaking; law to make or apply for an appeal and sense of justices. |
