| 摘 要： | 认罪认罚从宽制度与值班律师制度有着紧密的联系,值班律师制度的好坏直接影响着认罪认罚从宽制度的有效运行。当前的值班律师制度在运行过程中,体现出不具备辩护人权利、介入时间不确定、法律服务质量差、衔接机制不畅等缺点。这些缺点的存在使得认罪认罚从宽程序的设立初衷难以实现,造成程序难以启动、被追诉人虚假认罪、浪费司法资源的问题。通过分阶段赋予值班律师相应权利、明确介入时间、加强管理与与保障以及完善衔接可优化值班律师制度。

| Abstract: | There is a close connection between the system of leniency to plea guilty and the system of duty lawyer.The system of duty lawyer directly affects the effective operation of the system.The current duty lawyer system in the process of operation,reflects the lack of the rights of defenders,uncertain time,poor quality of legal services,poor linkage mechanism and other shortcomings.The existence of these shortcomings makes it difficult to realize the original intention of the establishment of the leniency procedure,resulting in the difficulty of starting the procedure,the accused's false confession,and the waste of judicial resources.Therefore,we should put forward corresponding suggestions to optimize the duty lawyer system by endowing duty lawyer with corresponding rights in stages,defining intervention time,strengthening management and guarantee,and perfecting the connection. |
