| 摘 要： | 公共利益是在法治国家和尊重人权的前提下提出的命题,在我国必须把公共利益从国家利益中区别开来,这样才能保证公权力行使的合法性和正当性,限制并克服政府权力行为可能产生的寻租心和盈利性。公共利益是法治国家的社会根基。
