| 摘 要： | 分析体育专有技术概念、法律特征及性质、侵权形式及救济措施,结果表明:体育专有技术不是<著作权法>规定的作品和<专利法>界定的发明专利,不能纳入以上两部法律保护,体育专有技术只能作为商业秘密纳入到<合同法>、<反不正当竞争法>等法律来保护.提出我国需要通过三种立法路径来完善体育专有技术法律体系,建立有利于体育专有技术创新的管理制度等保护对策.
