| 摘 要： | 采用文献资料法、逻辑分析法,从法律实务的角度,对我国体育事业的新途径、新体育主体、新体育社会关系及体育基本概念进行了探讨。认为:《体育法》应明确体育的基本概念、基本制度、国家对体育事业管理的权力结构、体育纠纷的内外部裁决途径和体育运营中各类主体的基本权利与义务内容。建议《体育法》明确与违法行为相对应的法律责任条款,通过法律责任支撑行为的规范与调整。

| Abstract: | Using the methods of literature and logic analysis and from the angle of legal practice,it inquired into the new channel of the sports source of our country,the subject of new sport,the social relation of new sport and basic concept of sport.It holds that "The Sports Law" should clear and definite the basic concept and system of sport,the state structure of power for the management of sport cause,the internal and external channel of making a ruling on sports disputes,as well as the basic rights and duty contents of all kinds subjects in the operation of sport.It also proposes "The Sports Law"ought to make clear the provision that any unlawful act should be undertaken corresponding legal responsibility and supporting the act norm and adjustment through legal responsibility. |
