| 摘 要： | 目的/意义]构建政府数据开放平台隐私保护评价体系,旨在指导政府数据开放平台隐私保护评价工作,帮助提高我国政府数据开放平台隐私保护水平。方法/过程]基于隐私政策视角,通过对美英澳政府数据开放平台隐私政策主题内容进行系统梳理与分析,结合我国政府数据开放实践,从"政府义务告知""隐私安全保护管理""个人权利保障"3个维度构建了我国政府数据开放平台用户隐私保护评价指标体系,并使用该指标体系对我国81个政府数据开放平台隐私保护现状进行了评价。结果/结论]研究发现,政府数据开放平台隐私保护整体表现较差,政府义务告知存在严重缺位,用户隐私安全面临严峻的挑战,且用户信息权并未得到有效实现。

| Abstract: | Purpose/Significance]To guide the evaluation of privacy protection of government data open platform and help improve its level of privacy protection, this paper built an evaluation system of privacy protection of government data open platform.Method/Process]From the perspective of privacy policy, by carrying out a systematic and comprehensive study of the privacy protection policies of government data open platform in the U.S., the U.K. and Australia, and combining with the open government data practice in China, this paper constructed an evaluation system of personal privacy protection of Chinese government data open platforms from 3 dimensions: government obligation notification, privacy security management and individual rights protection. Then, 81 government data open platforms in China were selected for an empirical analysis.Result/Conclusion]The results show that the overall performance of individual privacy protection of government data open platform in China is poor;there is a serious lack of government obligation notification, and there are severe challenges facing user privacy security;and the information rights of users are not fully respected. |
