| 摘 要： | 随着我国城市化进程的加快,大量的农村集体土地被政府纳入征收范围,土地变得越来越稀缺,由此引发的矛盾和冲突也日益激烈,农地征收中的农民的利益维护已经成为社会所关注的热点和焦点.运用博弈论的基本原理,通过对征地过程中地方政府、农民和开发商所扮演的不同博弈角色以及在博弈中的利益分配问题的分析,可以看出农民在博弈中处于弱势地位是制度缺乏理性所致.当前,应注重通过完善农地征收立法,提高农地征收补偿标准,规范政府征地行为,建立农地征收的程序性规范等措施,更好地维护农民在集体土地征收中的合法权益.

| Abstract: | With the deepening of China’s reform and opening-up and its economic development,requisition of the agricultural land in China has become increasingly frequent and the land becomes more and more scarce,which leads to increasingly fierce contradictions and conflicts.Thus agricultural land requisition has become a hot issue.Based on the dynamic analysis and game theory,it can be inferred that the reason why farmers are in a weak position in the game is due to lack of sound regulations and government functions by analyzing the different roles played by the local government,farmers and real estate developers in the game and its interest distribution.At present,the attention should be paid on the related legislation to improve the land requisition compensation standards and protect farmers’ legitimate rights and interests,so that the farmers’ legal rights and interests can be safeguarded in land requisition. |
