| 摘 要： | 转变政府职能是从源头防治腐败的必经之路。如何在政府职能转换的过程中强化而不是削弱政府的监管,是反腐制度建设中一个非常值得重视的问题。担保是市场经济环境下一种重要的信用工具,也是反腐败制度建设中的一个重要工具。本文以美国工程保证担保制度为例着重探讨了合同担保的腐败预防机制,并对反腐制度建设中具有重要价值的两种非合同担保———执照与许可证担保和官员忠诚担保———进行了简要的介绍,指出引入担保机制对于将事后惩戒转化成为事前防范的重大意义。

| Abstract: | Changing the function of government is inevitable if one wants to eliminate corruption from the root in China.However,necessary supervis ion from government should not be wea kened in the name of functional trans-formation.Credit guarantee is an im portant tool not only in market economic system,but also in corruption pr e-vention as it serves well for enforcing supervision.Based on a deep analy sis of the construction contact bond ing system in the US,two other guarantee products related closely to anti -corruption system are introduced,nam ely,license and permit bonds and public o fficial bonds.The anti -corruption mechanics of applying guarantee system is concluded as transmitting the risk o f credit back to its source,and transforming the system from punishment a f-terwards into preventive precautio n. |
