| 摘 要： | 信息产权指信息生产者、传播者对信息享有的人身权、财产权，知识产权指创造者对特定知识信息依法享有的专有权，二者的客体都是信息。知识产权以民法无体物理论为论据，以所有权为核心，目的是保护创造者的劳动成果不受非法侵害；信息产权的理论基础是信息学，关注其传播利用，目标是平衡信息创造者、使用者和传播者的利益。知识产权制度应有选择地吸收信息产权的合理成分，促进自身的发展创新。
