| 摘 要： | 目前，面对越来越多的学生诉高校案，高校在倍感“冤枉”的同时，不得不疲于消极应诉。反观高校学生管理的现状，缺乏程序缓冲机制的学生处分行为很容易产生不公正的结果，这种结果当然会遭到处于被动接受处分状态的学生的质疑。建立处分听证制度不仅能够保障学生权利，减少不必要的诉累，实现高校学生管理的法治化，同时也有利于高校管理的民主化，为构建和谐校生关系铺平道路。

| Abstract: | Nowdays, universities, faced with so many accuses from punished students, have to deal with them with reluctance. Reflecting on the present situations of the university administration, the lack of lenitive system leads to unfair outcomes, which would surely be questioned by the punished students. To protect the right of students, the construction of the hearing system should be constructed. It will reduce lawsuits and promote the legalization of university administration. It also helps establish the harmonious relationship between students and universities and realize the democratization of the administrion of the school. |
