| 摘 要： | 《物权法》所带来的伦理启示在于：它以法律的形式确认了一种新的道德范式即“常人道德”，以这种新的道德范式作为民事立法的伦理基础，使得法律本身无悖于道德情感，法律的运行也由此具有现实性。尽管《物权法》的颁布实施引发不少的学术论争，但是，从长远来看，《物权法》无疑是我国立法史上的一个里程碑，它的颁布和实施标志着我国立法开始进入自觉追求“良法”的时代。
