| 摘 要： | 伴随我国经济的快速发展,房地产业的发展速度也日益高涨,与之相伴的是高涨的房价。开发商和一般的卖房者为了获取更高的房屋出售价格,＂一房二卖＂乃至＂一房多卖＂的情形已屡见不鲜,纠纷不断,严重侵犯了正常购房者的合法权益,扰乱房地产市场秩序。根据我国物权变动模式及登记要件主义,来探讨＂一房二卖＂的法律效力,以及房屋所有权的最终归属。并对未能取得房屋所有权的买受人如何维护自己的的合法权益,提出建议。
