| 摘 要： | 目前,我国劳动者基本权益经常遭受侵犯且缺乏有效保障,原因很多,如劳动力资源丰富,劳动者自身缺乏权益意识;现阶段在解决劳动争议案件中,实行的一裁二审制人为地延长了诉讼周期,增加了诉讼成本,这种程序设计对劳动者实现其权利救济是不利的.同时某些地方政策的制定脱离现实,造成司法救济的不可能.

| Abstract: | The basic interests of Chinese workers are currently vulnerable to harms without effective protection. The analysis yields several causes, such as, more than enough labor forces, insufficient legal awareness of workers, overtime trials and increased legal costs during the likely proceedings. In addition, the local policies render it as hard as impossible to offer a legal protection to the workers. |
