| 摘 要： | 随着司法体制改革的进一步推进，必然涉及到司法改革行为的主体以及行为方向问题。我国应以司法改革的整体设计为基础，以司法改革的去行政化为行为方向，摒弃司法行政化的弊端以及与司法本质及其运作规律的不相容性。司法体制去行政化应从外部去行政化及内部去行政化两方面着手。

| Abstract: | With the steady progress of the judicial reforms in our country, we are faced with such issues as the reforms of the judicial systems as well as the direction of the reforms. The writer assumes that our judicial reforms should base on an integral designing, aiming at the de administration so as to rid its frailties. Specifically, the de-administration involves two facets, namely, external and internal. |
