| 摘 要： | 贝卡里亚深受启蒙思想家的影响,认为犯罪是对社会契约的违反;同时贝卡里亚为了反对封建社会的思想为罪,提出了＂社会危害＂理论,从而为判断犯罪找到了客观依据。社会危害理论的提出也进一步引证了贝卡里亚的功利主义思想。

| Abstract: | Becarias criminal law thoughts are deeply influenced by the enlightment thinkers,thinking conviction is an action of infringing social contract;In order to attack the fact that thought is a crime in the feudal society,he puts forward the theory of social harm,so that the judgment of crime is based on objective facts.The theory further proves that Becaria is an utilitarian. |
