| 摘 要： | 唐代大理寺是中央专门的审判机关,其主要职能是审理中央官吏徒刑以上的案件;其次,它还有审理天下疑狱以及奉旨遣使推勘地方案件之职。它并不审理京师徒刑以上的案件;它不是唯一的中央审判机关,也没有徒刑、流刑和死刑的终审权,不是中央最高审判机关。学界流行的它"负责审理中央百官和京师徒以上的案件"、"是全国最高的审判机关"等说法是对唐代法令原文的误读。

| Abstract: | Dalisi was the special central judicial organ of the Tang Dynasty,trying the law cases of officials above imprisonment instead of those happened in the capital city.Besides,it had the function to try the disputed cases and investigate local cases with the order of the emperor.Not being the supreme central judicial organ,it didn＇t have the final jurisdiction of imprisonment,exile or death penalty.Thus,the popular academic statements about the functions of Dalisi are the misunderstandings of the original act of the Tang Dynasty. |
