| 摘 要： | 网络期刊这一新的作品表现形式的出现,对如何适用著作权法提出了新的问题,其中关键性的问题是网络期刊的著作权主体和网络期刊出版者的权利,网络期刊的著作权主体包括网络期刊中数字化作品的著作权人和网络期刊的著作权人,其中数字化作品的作者是作者,而出版者则是网络期刊的著作权人.并且作者的著作权优先于出版者的著作权.作为作品的传播者,出版者除了享有著作权外,还享有版式设计权、转载、摘编权以及一稿多投禁止权等邻接权.

| Abstract: | The emergence of internet periodicals challenges copyright law,among which the key problems involve the copyright of internet periodicals and the right of internet periodicals publishers.The copyright of internet periodicals includes the authors of digital works of internet periodicals and those of internet periodicals.The digital works are produced by the authors,however their copyrights are owned by the publishers of internet periodicals.Obviously the authors' copyright claims precedence over that of internet periodicals.As the propagator of the works,the publishers enjoy not only the copyright,but also other right to design the format,reprint,adapt them and forbid the contribution of the same works to different magazines or newspapers at the same time. |
