| 摘 要： | 身份犯是刑法所规定的一类"特殊"的犯罪形式,由于对犯罪主体资格的特殊要求而与一般犯罪相区别。刑法学界对身份犯的研究一般是将重点置于"身份犯之共犯"问题的研讨中,而对于身份犯自身体系的研究则鲜有论及。为弥补此一理论空缺,试图将身份犯概念的研究作为重点,以此为前提检视消极身份犯概念。

| Abstract: | The status crime,which is different from the general crime due to the special requirement of the criminal subject,is a kind of special crime in the criminal law.The study of status crime from criminal law experts is more focus on the accomplice of status crime,and less discussion about the self-system of status crime.In order to make up for the vacancy of the theory,the author takes the conception of negative status crime as important field to study. |
