| 摘 要： | 法制现代化是法律文化发展的特殊历程,它表明社会法律系统由以自然经济为基础的传统"人治型"法律价值规范,向以市场经济为基础的"法治型"价值规范的历史转型.我国即将制定的民法典中,民法的现代化问题是一项不能不思考的重要内容.

| Abstract: | The modernization of civil law is a special course in the development of legal culture,which shows the historical transformation of social legal system from the traditional value category of "governed by people"on the basis of natural economy to the value category of "ruled by law" on the basis of market economy.China is going to lay down a new civil law,in which the modernization of civil law is an important content to be considered. |
