| 摘 要： | 释明权为法院与当事人架起了一座共同讨论交流案件事实和法律适用的桥梁,法官适度、及时地行使释明权,不仅能修正极端当事人辩论主义诉讼模式的瑕疵,而且有助于实现实质正义与程序正义。所以,将释明权在我国未来的《民事诉讼法》中加以规定,甚为必要。

| Abstract: | Right to Elucidation builds the bridge for judge and litigant to discuss and exchange the case fact and application of law.The judge exercises promptly the right to elucidation,not only can revise the slight defect in the principle pattern of the litigant debates,but is helpful to just the substantive justice and the formal justice. |
