| 摘 要： | 贝卡里亚之《论犯罪与刑罚》的全文充满了人文主义精神,其最重要的一个因素就是贝卡里亚从人性出发,尊重人类的感情。从而他质疑封建刑法对人类基本感情的蔑视,认为刑法在重视人类理性基础上,对人类基本感情的尊重,是刑法可行的条件之一。

| Abstract: | Becaria’s on Crimes and Punishments is filled with humanitarianism,whose important cause is that Becaria respects the basic emotion of human nature.Thus,he doubts that feudal criminal law disdains the human basical emotion,thinking that respecting human nature’s basical emotion is a requirement of operation of feudal criminal law. |
