| 摘 要： | 计算机软件著作权有其特殊的法律保护方式和法律保护原则，因此，侵犯计算机软件著作权的认定方法也与传统侵权行为的认定有所不同。为了有效地保护自己的合法权益．计算机软件著作权的权利人应当在诉讼中明确其举证责任以及举证要点，有针对性地提供证据，以证明自己的诉讼主张。

| Abstract: | The protection methods and principles of computer software copyright are distinguished from the traditional ones. Therefore, the ways to confirm the tortuous actions are also different from the traditional torts. In order to protect one＇s own lawful interests, the holders of software copyright need to know his burdens of proof and try to prove his claims by effective evidence. |
