| 摘 要： | 关于民主与专制的争论早已是老生常谈的话题。但是，将这一经典提问纳入到环境法中来，对环境保护中权力与权利配置进行的拷问却不多见。在环境保护中，环境行政权是环境管制的核心体现；而公民环境权是环境民主的生动彰显。环境问题的不可逆转性，决定了我们不能像宪政领域里的民主那样，宽容地给予公民一段充分的民主训练期。基于这种考虑，在环境保护中应当建立一种“管制为主，民主为辅”的权力和权利配置思路。
