| 摘 要： | 内幕交易、泄露内幕信息罪的犯罪主体是一般主体，而不是特殊主体；其犯罪主观方面只能是故意，过失不构成谊罪；“信息尚未公开”是判断内幕信息的重要标准，至于市场是否消化该信息与内幕信息的认定无关。
