| 摘 要： | 国际责任规则中国际组织概念的设定,应既能够涵盖现实中形形色色的国际组织,同时又能够符合国际责任规则的国际法性质。通过分析学术著作中关于国际组织概念的论述以及条约中国际组织的使用含义,可以认为国际组织责任规则中的国际组织,为国家间或国家与其他实体,依条约或其他受国际法调整的文书而建立,具有国际法主体资格的组织。

| Abstract: | The work of setting the meaning of international organization in the framework of international re sponsibility should fulfill the following criteria： first cover all the international organizations reasonably and second tally with the nature of the rules of international responsibility as international law.Therefore,based on the analysis of the formulations of the concept of international organization in academic works,and in reference to the practical cases where the term of international organization is used in relevant treaties,the term of international organization adopted in the international responsibility regime can be conceivably referred to as an organization possessing its own international legal personality established among states or between states and other entities by a treaty or other instrument governed by international law. |
